Private companies cannot issue fines even though they like to pretend that they can. Their claim is that you entered into a contract with them for parking when you read their signs & that by not displaying a permit you were in breach of that contract so they are claiming damages. However under English law they can only claim genuine losses for a breach of contract they cannot pluck a figure of £100 out of the air & 'fine' you. As they have suffered no loss at all there is no basis for you to pay any damages.
A couple of examples.
If you purchased a car but delivery was late you might be able to claim damages for renting a car while awaiting delivery but what you could not do is claim £5000 damages where you had not lost that amount.
If you stay at a hotel that costs £100/night but don't check out when you should. They might claim damages but the most they could claim would be £100 i.e. the cost of another night. They could not claim £1000 even if they had a sign up in reception stating that they could.0 -
Thanks a Bazster. I just called my friend and he said that in the tenancy agreement, it is mentioned that visitors can park if a visitor permit is displayed in the car which was not in my case.
Since there was no visitor permit displayed in the car, should I pay the charge? They are asking for £100 as fine. The car was parked in the visitor bay at between 9 and 10 PM.
I think it is the same scenario for Logick too! I meant about visitor permit not displayed in car.

It is rude and annoying to hijack peoples threads.
But you were asked about the free/leasehold NOT the tenancy agreement
UKPC dont do court and can be easily defeated.
So stop worrying about these people and follow stromas advice

Er, no, I asked if the property is owned or rented, and if the latter what the tenancy agreement says. How would a tenant know what's in the free/leasehold?
It's a bit much to berate a newbie for hijacking a thread. Most fora get stroppy when people start new threads on a topic which is already being discussed. This forum is the opposite of that, so how is a newbie supposed to know?

I sincerely apologise. I thought the nature of parking notice was same i.e. parked in visitor space without displaying visitor permit at private apartments and same PPC i.e. UKPC.

Thanks for the advice; my girlfriend however is concerned that if she loses the POPLA appeal, UKPC will be more likely to take her to court, and the lost appeal will weigh against her.
What would a lost POPLA appeal really mean for her?

She won't lose if she words it in the usual strong way we advise - and hapless victims who might lose a POPLA appeal because they've worded it weakly, can just ignore the PPC scam after that (the decision is not binding on the motorist!). We win 100% of POPLA appeals now and whilst it is feasible that a PPC might win one sometime as they attempt to unpick our wording, I would take bets against that being UKPC!
And seeing as the only time UKPC have ever been near a courtroom was when they were taken there (twice!) please tell her she's got as much chance of this lot suing her as winning a fortune on this week's EuroMillions.
