returning deposit

hi all
just needing some advice
we have been renting a property for last 15 yrs
landlord in this time has only replaced a systen in this time we are moving out at end of month nothing has been upgraded in this house since 1986(was holiday cottage ) b4 that front room /stairs ./bedroom carpets have all been here since then we have replaced kitchen carpets
what is fair wear and tear
he has known for 18 months downstairs toilet has a big craack in it but still has done nothing about it can he charge us ?
can he withhold bond he is inspecting the property when we move out

    Very unlikely considering how long you have been there.
    Google deposit protection service to find out your rights (and to find out what you can do to the landlord if he hasn't protected your deposit).


    Did you sign an inventory when you moved in describing the condition of the place?

    No: Bonus! You are clear as the landlord cant prove any damage was down to you.
    Yes: After 15years, you would expect most things on the inventory to be worn and need replacing / redecorating anyway. The deposit protection service will be the arbiter of this.

    Did the Landlord register the deposit ?
    Has the property got gas heating, gas fire, gas cooker? Did you get a gas safe cert every year?
    Another POOR Landlord who has none nothing over the last 15 years so I hope you have paid the same rent for 15 years??
    Ask for your full deposit back

    What type of rental agreement do you have? When did your current rental agreement begin?

    And a landlord is legally required to put the deposit in a protection scheme, even if the tenancy pre-dates the creation of the scheme.

    My understanding is the only exception to this is if the OP has had a periodic tenancy running continuously since before April 2007.

    we have no heating upstairs
    only coal fire which runs 3 downstairs radiators
    we sign a 6 months short hold assurred tenancy but asked after that was up if we where happy it would just continue (didnt want to pay another leagal fee)
    only electric in the village so no gas
    he is inspecting the house and he said he will be dealing with the bond

    can i just say my landlord lives nxt door to us and has never wanted to inspect the house in 15 yrs (

    I thought that this exception now no longer applies, and that ALL tenancies where a deposit had been taken had to have the deposit registered.

    Only where there has been a change of tenancy, so if it became periodic after 6th Apr 2007 or a new fixed term was agreed.

    I rented a flat for 8 years and was told by the inventory man on check out that everything would be put down as wear and tear after 8 years, got my full deposit back.
