Ok, so I have driven my self mad reading this stuff.

I am Wales (which I think is no diffrent to England in this matter).

My AST says (laid out like this):-

Term: 12 Months
Commencing on 28/06/2008
Rent: £xxx Monthly
Payment: in advance by equal payments on the 1st of each month.

I exchanged on a purchase today to compleat next week.

I am going to post my notice in the morning (too far to serve by hand).

What date will be my last day?

    postal correspondence is deemed to be served 2 days after it was posted, so bad luck you are 1 day late. Your expiry date will be 27/8/13, ie 1 full rental period

    of course your LL may not know that and may take 27/7/13 at face value....
    just ask!

    It's close enough to 28th that I would consider hand delivering it if at all possible.

    If not, and this is to a letting agent, then you could pay extra for same day delivery and then call them up to check they got it. Not much you can do if they say they haven't, but at least you'll know.

    You could pay for same day courier service. Assuming LL signs for it on receipt.

    Or as 00ec25 says, discuss with LL. We're not all so inflexible as this forum might lead you to believe!

    Ok thanks, I suspected so. I am going to post it, its over 200miles away and to a residential address so no signature likely in the day.

    Going to try my luck for the 28th July (using Crate v Millar) and hope the LL is either reasonable or not quite up on the 2 day service thing.

    Will speak to the agent in the morning as well.

    Worst case is I have to do another notice but I have 28days or so to get that sent.
  • For the cost of a months rent you could probably pay some guy from the pub to drive there and hand deliver it and have enough left to get a few rounds in after, there'll be professional couriers that will do it for much less and there's got to be at least one that will deliver in the evening.

    Did you sign a new 12 month AST each year or did it just carry on as a periodic tenancy after the first one ended.
    It's someone else's fault.

    Will they accept notice by e-mail?
    Yes I know, I know..... people are rightly legally sceptical of this.

    However, I served notice on our last let by email (dropping a letter in the post at the same time). I received a prompt same-day email reply from the landlord acknowledging this and thanking me.

    It would be a strange court that did not honour this. However, I did send a letter as a backup.

    This is the way I gave notice as well and it was accepted with no problems. I also if memory serves did not give the correct notice period as I don't think it was 1 full rental period. But seems the company that managed the rental didn't have a clue and I got away with it. :T

    email not ideal but

    as I said above, many LLs are reasonable (about flexibility on dates AND about how notice is served). If that's the case, noproblem.

    It is only when a LL sticks rigidly to the law that things like dates and method of service become important.

    If there is no other way, then put the letter in the post 1st class, and attach a copy to an email as well.

    9 times out of 10 (well, maybe..) the LL/agent will be happy.
