If you started work on 8 July 2008, one year was completed on 7 July 2009. So five years would be completed on 7 July 2013. I believe that if Sunday 7 July is your last day of employment it means your redundancy pay would be calculated on 5 years. If your last day of employment is actually Saturday, 6 July, then you would not have completed 5 years at the time. Whether there are 365 or 366 days isn't of importance here.

You would also have been entitled to receive four weeks notice (or longer if your contract has more). If your last day is 7 July, you need to have received notice on or before Sunday 9 June.
  • Thank you little voice I was told on Tuesday the 25th of June (yesterday) that I would be made redundant on the 7th they originally said I would get 4 weeks notice and 4 weeks redundancy but they then said it would be 5 weeks notice and 5 weeks redundancy because of my start date but they would have to double check it, so it's left me in limbo with it, with regard to not receiving notice on the 9th of June I'm a bit confused about that? Thanks

At the time they gave you notice (25 June), you were entitled to 4 weeks' notice (unless your written particulars said more - eg one month). You should therefore receive pay for up to 23 July inclusive. (To later if you were contractually entitled to longer notice.)

Your statutory notice period (the 4 weeks) takes you comfortably beyond your fifth anniversary of commencing employment with them so your statutory redundancy pay should be calculated on that 5 years service. The number of weeks will depend on your age.
