Replacing a fence belonging to a rented house

Hi there,

So I want to replace the fencing in my back garden on all three sides as it is in a sorry state. So I am ok doing 2 side as they are mine but one side is owned obviously by the next door house. But this house is rented out so I am going to have a chat to them and find out the LL's address.

Now if I can get the address (I hope I can as it is let by Choices and I know how bad they are so might have to deal with them :() I was going to suggest that the LL puts in 50% of the cost of doing the fencing (if this is not acceptable I am willing to pay for the lot), and this will be in a written letter.

Now my concern comes if I can't get the LL details and have to go through the letting agent, I assume I should just insist that I get written confirmation from the LL about doing the fences?

Is there anything else I should consider as I can't think of anything else?

    Why would you spend your money improving the LL's property? You could get and S21 next week.

    It's next door that's rented out.

    Personally I can't see them objecting to you putting a new fence up at your cost, there's a good chance they'll be happy enough with the existing fence and won't want to contribute.

    Worst case scenario you can put a new fence up on your side of the boundary.

    I think it's next door that's rented. I guess the OP is owner-occupier.

    If it's his fence, he can just ignore you, he doesn't have to agree to your proposal, even if you offer to pay 100%

    Yeah its next door that is rented, I own my house. And yeah I understand they may refuse point blank, will have to wait and see. Thanks for the comments.

    Not sure what your Q is...

    You seem to understand that you have no right to remove/replace a fence belonging to a neighbour.

    Therefore, as you say, you need to contact the owner (not the occupier) and get permission (peferablyin writing).

    To find the owner

    * ask tenant/occupier
    * ask letting agent
    *pay Land Registry £3.00
    * ask other neighbours in street
    *put letter through door addressed to "The Owner - please forward"
    * post letter via Royal Mail (owner may have RM forwarding in operation)
