Debenhams and cancelling orders

On the 22 of this month I purchased a Rocha John Rocha mens bag in there sale. I received a confirmation order and my American Express was charged? I have now been emailed by Debenhams that they are unable to fulfill my order and that they will refund my money.

Since Debenhams took my money are they allowed to just cancel and refund or can I insist that they provide me with what I have ordered?

yes, they can cancel your order.

If you check the T&Cs (that you probably clicked a tick box to say you read) would have in there that contract formation occurs on dispatch of the item.

Just looked back on the site and amazingly the same bag is available to purchase again, just at the slightly higher price of £35 when I ordered it for £23.80!

Could well be that they assigned a fixed amount of stock to the offer. Your order was processed after that stock was exhausted, so they are cancelling the order and refunding you.

As said above - YES, they can do this. I'm almost 100% certain that their T&Cs state that contract is formed on despatch of the goods.
