accident abroard

hope someone can help, i have just returned from holiday in turkey, whist there i had a fall in hotel reception due to a puddle of water on floor, was taken to hospital , i have a fractured ankle which is in plaster and torn the tendons in my knee. so question is can i claim on a no win no fee bases as it was abroad and if so any help with who i go to as been told to be careful who i go to. Thank you

    Is your plan to bring a claim against a TURKISH hotel about a incident in TURKEY in an ENGLISH court?

    If so, you would need to pursue them in the courts, on the basis their agents (i.e the hotel in question) were negligent.

    Your travel Insurance may include legal cover to pursue the claim

    Turkey are not mugs like the UK
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    It is worth noting that whilst there won't be any jurisdictional issues if this was a package holiday (because you will claim against the holiday company and not the hotel directly), the standards that will be applied to the case are different to those that would be applied over here. In short, in order to win a case of this nature you need to demonstrate a breach in local standards. It is not sufficient to show that they breached standards that would be expected in a hotel over here, because clearly Turkish hotels are not bound by those standards.

    As a result in can be tricky to win cases of this nature, but ultimately as with any personal injury claims you need to secure legal representation either by using a relevant legal expenses policy (as dacouch has said, there may be one attached to your travel insurance) or by entering into a Conditional Fee Agreement (which is the technical term for 'no win no fee').
