ParkingEye - appeal referred for further information

Hi everyone, I sent the standard appeal response to my fine letter as suggested by many people on here, and instead of the appeal rejection letter I got one saying that it had been referred for further information.
It's a pretty standard letter that acknowledges my appeal. It says "you have stated that you were not the driver of the vehicle ..." Which I didn't (I used the standard first appeal letter that's doing the rounds). They then give me 29 days to tell them who the driver is. Also, no POPLA code obviously.
A bit thrown at this point as was expecting the standard rejection letter, so what do I do now?

I seldom end up where I wanted to go, but almost always end up where I need to be

I would disagree with the first bit that advice. Never say who the driver is; they can only pursue the keeper if they jump through all the right POFA 2012 hoops, which they may not have done (early PE letters were not compliant).
I would agree with the second bit. Write to PE stating you have nothing further to add, and that you will not be providing further evidence or information or answeing any more questions until POPLA. This starts the 35 day timer ticking again. PE are very good at running out of time and therefore losing by default, so make sure you help them achieve this goal! It is a new ploy connected to the fact they - Parking Eye personally asked for it - have got the BPA Code of Practice to be changed a little, in that they no longer have to reject after 35 days (they have given themselves some 'faffing about' room). This faffing about with no POPLA code is what we will see from Parking Eye from now on, IMHO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
