Notice pay

hi, I was given notice on Friday 21st that i was redundant (following 2 consultation meetings). I am now trying to sort out my notice and redundancy pay. The redundancy pay is straight forward - i have been there 9 years and this is all in order. However my employer says i am on a months notice but i understand my notice to be 9 weeks also? further to this they want me to work the month - however my understanding is that if i work a month they have to pay me for the remaining notice weeks - is this correct?

Plus i also asked if i could finish earlier - they agreed in principle to only staying a further 2 weeks however by doing so they were only going to pay me for 2 weeks notice - this seems a crazy thing for me to do - if they were not paying me in lieu of notice then surely i am better of working my full notice period which is 9 weeks - advice please??

    You are right that you are due nine weeks' notice from your employer if you have completed nine years' service at the time they give you notice. That is your statutory right and cannot be overridden by a contractual notice period of less.

    Regarding your leaving after two weeks instead of working four weeks as originally requested - that would be your request to finish early and I do see that, from their point of view, they would not be getting those two weeks worth of work from you and so why should they pay it.

    If I were you, I would work whatever length of notice they requested (up to the nine weeks) but, if they actually do not want you to work the final five weeks then they still have to pay you.
  • thanks for your response. When i asked to finish early it was more a request of good will to let me go early and pay me the rest of the notice period so obviously they missed my point! At least i know i have my facts right and it looks like i will be there for a few weeks more!
