hey guys
I am having a major issue with my mortgage lenders and could do with any help or advice as im not sure what to do now
I changed my job and was told by the new employer that I may not be paid for the first month so me and my partner thought what if we can't pay the mortgage for a month, we phoned our provider and chatted over the issue and they suggested as part of our package we could have an agreement with them to pay a lower payment for 3 months so we could make sure we didn't default and that it wouldn't effect our record as we had set an agreement with them. We took out this agreement and had a letter confirming the arrangement and thought that was easy and a great reaction from the bank.9 months on we went to see our financial adviser gto look at remoartaging only to be turned down because of our credit score??? we thought this seems odd as all accounts were up to date so I looked into our files and it turns out that the bank have put down that we have defaulted and missed our payments for the last few months??? we haven't missed any payments at all since first having the mortgage and also that after having the 3 months at the lower rate we agreed to pay back more then we needed to so we could catch up quickly ??!!!!!! how can they do this? we took out the deal with them as they offered and also we were trying to do responsible banking so we didn't have this on our record. I have written a complaint to the bank and didn't hear back for weeks so I then re sent the complaint via recorded delivery and gave them 7 days to response only to be told there is nothing they can do for us!!!!!!!
this will now stay on our record for 72 months and we can not do anything as our rating is now poor thanks to them.
how can they put down on our record that we have missed payments for 9 months when we have never missed 1 payment, my only error was trusting them with an agreement that clearly never stood for anything! i'm so lost now and its so unfair as the reason to remortgage was so we could pay off outstanding loans and start again and within a few months all my plans have been ruined by one bank!
the whole process has been a nightmare from phoning them and telling us they do not keep records of the agreement letters they post out to customers to them leaving us paying for phone calls for 20 mins at a time while they go and ask one person after another its such bad service!
I could really do with help guys
thanks

Hi and welcome,
Firstly you need to clarify exactly what the credit report says. It will be a number or some kind of update on the account. If you can, try and post a screenshot (taking out the personal information obviously).
Secondly - have they actually defaulted the account? If they have, it will say 'default' and there will be a default date next to the entry. If this information is there, post it so we can see what we're dealing with. This is very different from marking a late payment, so you need to be clear if they have done this.
It sounds like they have marked that you have made reduced payments for those 3 months and then continued to do this because you were still behind on the repayments technically, even though you're paying every month.
Morally they should definitely have told you that this would impact your credit rating, but legally I don't think they were obliged to.
Unfortunately it sounds like they have recorded the information accurately, but without a screenshot we can't know for sure.
If it is inaccurate information, you would definitely have a case to take to the FOS, who will escalate this matter for you, but you have to be 100% sure of what they have reported.
Hope this helps.Fritterati Challenge for 2013:
