Travel insurance claim. Urgent advice needed

    Is this on page 6 of your policy wording?

    Important limitations – Cancelling and cutting short your holiday
    This policy will not cover any claims under section A (Cancelling and cutting short your holiday) that result directly or indirectly from any medical condition you knew about before the policy started, and that affects:
     a close relative who is not travelling and is not insured under
    this policy;
     someone travelling with you who is not insured under this
    policy; or
     a person you plan to stay with on your trip.
    They will not be covered if during the 90 days before this policy started, they:
     needed surgery, inpatient treatment or hospital
    consultations;
     needed any treatment or prescribed medication; or
     were on a waiting list for, or knew they needed surgery,
    inpatient treatment or tests at any hospital or clinic when this
    policy started; or
     had been diagnosed with a terminal condition (that will cause
    their death) before this policy started.


    I'm guessing that if the original post on the other forum was may, some of that applied at the time the cancellation was made. Mainly the 90 day treatment / consultation & medication exclusions.

    Apologies if this isn't possible, but shouldn't this claim be taking place on the partners insurance policy?

    I don't think it matters who has paid for it. The loss has resulted from a event that he was insured for, and so any losses coming from that event are covered.

    She wasn't named on the policy so would the insurers speak to her?

    She may not be named, but his insurance will say something about other travelers. So something like cancellation of whole trip due to his illness should cover the whole cost of everyone impacted by his death.

    They may not speak to her directly, but whoever is the executor can talk to the insurance company and make a claim on behalf of his estate.

    Incorrect kmmr- insurers will only pay for those named on their insurance certificate, regardless of who paid for the trip or those travellers insured elsewhere. Perhaps her late partner has a claim for his half of the trip, providing that he declared medical conditions etc to his company.

    From the above posts, I have to agree, this is simply not covered.

    Hi All

    Just an update I would welcome your opinions/advice on.

    There were 4 people going on this trip, (my mum, her partner, his brother and wife)
    My mum was insured with Virgin, her partner with Staysure (i think) and his brother and wife with Insure & Go.
    The claim for all four was handled as "one" by the travel claims direct.
    Everyone has been paid out apart from my mother.
    Virgin rejected her claim on the grounds that her partner had a medical history.

    I have written to Virgin and asked them to reconsider stating that everyone else in the claim had been paid.
    They responded stating that the other people had different insurers stating that their policy wording would have been different so this does not set a precedent.

    I looked at both the policy documents for Virgin and Insure & Go and they have identical wording.
    I replied to virgin enclosing the two policy documents and again asked them to reconsider also stating that although her partner had a medical history, that he died from a sudden cardiac arrest, the cause of which was not determined.

    I received a letter from them again rejecting her claim on the grounds of his medical history. There was no mention of the policy documents I sent in. This was a finanl response and should I wish to complain further I was directed to the financial ombudsman.

    I have since found out that Virgin travel insurance and Insure & go are the same company.

    To me (and i know im biased) this is not fair. How can the other parties be paid on the same claim from essentially the same company.

    Any suggestions?

  • Sorry to sound negative but in all the experience I have Travel insurance never pays out. There are so many exclusions and opt outs. During the ash cloud very few people were successful. I was one of them. I know these are different circumstances but the general principle is the same. You either lose out through large excesses or they refuse the claim. I am willing to be proved wrong. However, I do not rely on travel insurance other than for the most extreme cases (ie where you need it for hospitalization in USA).
