PPI reclaim MBNA card but being told it was Santander

Morning!

I am hoping to get some advice on here about a ppi claim that my husband is in the process of making. He made the original complaint with MBNA. This has been resolved really quickly and they have upheld the complaint and we are currently waiting for payment. However they have written to us and told us that they took over the account from Santander and have also passed on the complaint to them as they have only refunded ppi from when the card was with MBNA. Santander have written to us asking us for information and proof that we paid ppi. We have none. My husband phoned this morning and asked what info they would like and the girl (who as very rude and sounded like she was reading from a script!) said they needed statements as they don't keep anything from longer than 6 years ago. We don't have any statements. Can anyone advise us if there is anything we can do? Surely if MBNA upheld the complaint then that is proof we had PPI??

    Smetimes if the amount is small, companies will auto-pay an amount, which sounds like happened with MBNA.
    You will have to send a SAR and £10 to Santander and see if there is any info left. If there is, complain again, otherwise, your complaint is over.

  • Thanks for your reply. It's just over £1000 we're due to receive from MBNA. Would they auto pay that amount? The balance on the credit card was huge. Do we take the lady from santanders word for it when she says she has no information?

    Yes, they'd pay that as an auto-payout.

    Well, if you want to complain, you don't, you send a SAR and £10 to find out what information there is. They may well have destroyed all of it, they may not have. It willcost you £10 to find out....See the front page for an excellent template SAR.

    Surely if MBNA upheld the complaint then that is proof we had PPI??

    It suggests you had PPI at one time.

    It does not prove you had it when Santander (or more likely Abbey National) issued your card.

    Nor does it prove how much you paid.

    Finally, it does not prove it was missold.
