Can Mum claim PIP?

My Mum was a full time carer for her mum for 11 years until nan passed away just over 2 years ago.

Following nan passing, mum went to the Job Centre to claim Job Seekers only to be told that due to her NI not being paid she couldn't claim.

Mum has now found out the she has a large chance of being officially diagnosed as having Lupus which has affected her foot causing her severe pain at times.

Lupus is considered to be a disability and therefore PIP (formerly DLA) should be applicable however I'm concerned she's going to get the same response she did from the Job Centre.

Please could someone confirm that she shouldn't have a problem receiving what she is entitled to and requires.

    Surely a painful foot does not make her incapable of working.

    DLA (now PIP) is awarded on the grounds of care and mobility needs not on the diagnosis of an illness/medical condition.

    Have a look at the descriptors here:

    You say that your Mum did not have sufficient NI contributions to be awarded JSA. I am presuming that she has a partner/married who is working? If she hasn't and has no other income/lowish savings then she would have been entitled to income based JSA.

    Have you put her details into a benefit checker?

  • ILW - PIP is paid regardless of whether she can work or not and actually yes a painful foot can stop her working when she can barely stand or walk and sometimes doesn't even need to do that to be in agony! The Lupus is attacking the joints in her foot which is incredibly debilitating.

    Thank you pmlindyloo - yes my Dad does work but...well let's put it this way...I earn more than he does and they have no savings. I'll pass the link over to my mum to fill in as I don't have all the information on them to fill it out. thank you for the information it is appreciated.

    This would be for Contribution based JSA, depending if she has any other income or savings she should look to claim income based JSA.

    If she was claiming carers allowance while looking after Nan, wouldn't these have given her NI credits.

    DLA (PiP) can be payed if she has care and/or mobility needs, and she can be in or out of work while receiving it.

    CA (and indeed child benefit, ESA, ...) give NI credits - however - these are only worth anything (in most circumstances) for pension eligibility.
    They do not entitle you to means-tested benefit.
