Parking Eye What's the worst they can do if i ignore?

Hello, I have just got a letter for a parking charge notice from Parking Eye for £100 (£60 if i pay within 2 weeks) as i pulled into a service station to sleep as i was on the way home from a festival and could tell i was far too tired to drive home, I was nearly falling asleep at the wheel and thought it was legal to stop and rest, especially if i was unfit to drive. There are photos of my car and the date/time, i didn't see any signs that i had to pay after 2 hours or i would have. So as it's a private/profit company and not council, if i ignore the letters would they really bother taking it further? and is it better to completely ignore all the letters or appeal? as they have no confirmation i have received the letter etc. thanks for your help!! :)

The current advice is not to ignore but to take the fight to them.. Ignore just leaves you not knowing what they will do next. At the moment they are particularly litigious as their new Legal Assistant is determined to make a name for herself by pursuing via the courts any ignorer who still has a pulse beating !! It will backfire as can be seen from the Aldi FB page.

So the worst they can do is try their hand at court. But, it can be headed off in your favour well before this via POPLA, and with advice from here or Pepipoo.com, you can put forward a pretty unassailable appeal that can see off most PPCs.

So, first things first, you need to send off a 'soft appeal' to PE in order to hook a POPLA code to really get things underway.

Here is an example of a 'soft appeal', perfectly in order to use this as a template.

Get this off and come back when you receive the POPLA code. Meantime, you might like to do a bit of reading of POPLA appeals - what wins and what loses - but we've no intention of letting you lose.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Parking Eye have recently taken the first steps in taking lots of ignorers to small claims, suddenly. That's the worst case scenario, especially if you ignored the small claim or lost in court.

Seeing as we know how to word winning POPLA appeals what's to lose?
