Redundancy Notice Pay

was wondering if someone could give me some advice/pointers regarding my situation.

We were recently told that we were being made redundant. We were part of a store that has over 20 staff and have been put into a consultation period. I will try to make the main points simple to help with any advice given

1 -The shop we work in closed this weekend
2 - The Company is part of a larger group with 2 other branded retail stores.
3 - Management are required to work Consultation within the same brand. Staff can continue there consultation within any of the brands
4 - On the 11th we received our redundancy calculations with explanations that if an alternative role wasn't suitable they would "If applicable we propose to make the following payments to you on termination of your employment" There is then a breakdown of redundancy and number of weeks notice.
5 - We had our first consultation on the 11th and our 2nd on the 18Th. On both of these we were told that we wouldn't be required to work our notice. This was taken into consideration when people decided on relocation/redundancy.

As of today we have been told that last week a decision was made that all staff were required to now work there notice. This has obviously contradicted everything that was said prior. HQ have said this was cascaded down through Regional managers and the store managers. Our store manager has no account of being told this. There is no physical evidence of this been passed to staff prior to any consolation. The only break down we ever had with payments that would be made included pay for notice.

The short question is, can they now legally make us work our notice after agreeing to pay it as part of the final payment? Feels like they are changing the goal posts for any one wanting to take redundancy.

Any help would be more than appreciated.

  • Hey -Just a little more information regarding my situation. May help people understand the situtation a little more.

    I have come to this site to try and get some help with a redundancy that i am going through with my current employer.
    I have recently had 2 consultations with my employer regarding being made redundant. I was given a break down of payments that wound be made on my last day of consultation. This included redundancy payment and notice payment. The letter that i got stated:
    "Should you not have been deployed into a position deemed to be a suitable alternative and you have been employed with ***** for a continuous period of more than two years, you are entitled to receive a statutory redundancy payment. This is calculated by reference to the period during which you have been continuously employed, your age and your gross weekly pay. If applicable we propose to make the following payments to you on termination of your employment:"
    States:
    "Date of termination of continuous employment: 12/07/2013"
    I had to call HR for something unrelated today and they mentioned in passing that i had to work until the middle of September as they have decided that i now have to work my notice period?!?! I have never had this in writing and was told our line regional manager should of let the store manager know. needless to say......the store manager denies being told anything.
    Surely they cant just change there mind?
    any advice is more than welcome.
