Newbie help with First Plus PPI claim

Hi all, I am new to this forum and hope I am posting in correct place! I took out loan with first plus ( bad move I know) in 2004 and had PPI added to loan, we were told we had to have it and was sold on the 5 year cashback offer, very soon after we took it out we realised it was a mistake when I became ill and my husband had to become my carer so we lost both incomes, we made a claim on PPI which we had to fight tooth and nail for as and they paid out a total of £3000 ish then ofcourse paid out no more, so we were stuck with nearly £8000 of PPI on this awful loan and ofcourse all the interest on it too !! we attempted to make a claim for missold PPI a few years ago and got nowwhere but I wasnt prepared to give up so in Sept 2011 I forwarded the complaint to financial ombudsman and filled in all the relevant forms and sent all the evidence but since then all I have had from FOS is they are so backlogged and will deal asap, things are still bad health wise and I am now disabled and hubbie my carer so we have some fairly big arrears on loan which they are letting us pay back, it is more than we can afford and few times they have got close to legal action but I have always managed to pursuade them to let us carry on with payment plan, it is very stressful and health not getting worse because of it , this morning I had a long chat to First Plus and actually spoke to a very nice and helpful lady ( I know dont faint !!) she told me that first plus had now been writing to their customers admitting that the PPI was probably missold and that I should call their dedicated team and see if they could help, I called the team and explained situation and was advised that if FOS are dealing it is best to contact them first and see what is happening , so I spoke to FOS and explained that it is now getting more desperate because of arrears and that if we could get the PPI back it would easily cover arrears and reduce the monthly payments and he was very helpful and said that as now we were clearly in financial hardship he would fast track our case. My questions are: 1) do you think that we have good chance of claim even though we already made a claim and it paid out ( I realise this sum will be deducted off any payout) and 2) we apparently took out the loan with a company called Central Capital Ltd ( I dont recall this and thought I dealt with FP direct) are they responsible for pay out or is it down to first plus?? I know that the financial ombudsman will do what they can but I just wondered what you all think and if any of you have had same issues, thanks very much

    Single premium is considered bad in most cases. Not covering the whole period of the loan is another bad one. So, you have some strong reasons.
    2) we apparently took out the loan with a company called Central Capital Ltd ( I dont recall this and thought I dealt with FP direct) are they responsible for pay out or is it down to first plus??

    If that was the case, FP would have rejected the complaint and told you to complain to them. if FP are accepting liability for the complaint then it is not an issue.

  • Thanks for your answer, they did originally steer towards central trust who wrote back to me saying that 1) they were not regulated at time and that even though I original complained about PPI in 2007 and then again in 2011 it was over 6 years since we took out loan so we couldnt claim, do you know if this is correct ?
