Section 75 proving purchase problem

Hi,
I told my credit card company that I wanted to make a claim under section 75. But as when I initially complained they keep saying that I haven't proved my case. This seems to be a fob off. When you have been scammed or they have not sent you a contract (which they always ask for). How can you prove it seeing that a contract can be verbal!?

For S75 YOU have to prove "breach of contract or misrepresentation"
Can I ask this simple question.
If you were scammed why have you not taken the company to court?Never ASSUME anything its makes a>>> A55 of U & ME <<<0
