I appreciate this has been asked before but all the threads confused me in the end. I got a parking charge notice in a Tesco car park for over staying, where do I stand on this? Pay or ignore? In actual fact on that day I did have my Mum with me who is a blue badge holder does anyone know if this changes anything? Thanks from a confused new poster:o

Yes the Blue badge holder changes everything, as your passenger is allowed more time to shop and is protected by the Equality Act 2010.

You should neither pay nor ignore.

Your first port of call should be the Tesco CS desk but ask ONLY to see the Store Manager themselves, to discuss cancelling this ticket. DO NOT BE FOBBED OFF by anyone else. Let us know how you get on, here's a BBC article (written before the DDA became the Equality Act) which explains the law. Print it out and take it with you:

    http://news.bbc.co.uk/1/hi/uk/8488737.stm

If you do get fobbed off (which would be illegal in fact as it would be a breach of the Equality Act as soon as Tesco know about their agent's actions!) you can take it up with Tesco Head Office.

And you can appeal the fake PCN to the company which issued it (Highview?). Here's a pepipoo thread with short appeals linked, shows you the style of challenge wording to use to a PPC, telling them nothing about what happened nor who was driving. Although you could add 'the passenger on the day is disabled so is allowed longer to shop'. DO NOT SAY WHO WAS DRIVING (so don't say 'my passenger'):

    http://forums.pepipoo.com/index.php?...st=20&start=20

There is also a second, independent appeal stage called 'POPLA' where you will win if knocked back by Tesco and Highview (as long as you word that stage right). Two stages is all it takes to get this quashed so come back for help before you send off your POPLA appeal in due course, if you have to go that route there are certain appeal points to include. We can help you with that if needed.

You will not be paying a penny so don't worry about the discount deadline. Let us know how you get on at Tesco and don't be passive - it's not an 'appeal' - be assertive about it, deep breath and march up to the CS desk and get the Store Manager in front of you!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
