Apologies my head is doing overtime as I have my final consultation tomorrow.
Trying to work out my accrued holiday and bank holiday allowance.
I understand the holiday calculation however when my last day will be part way through a month can i still claim the time?
Example- entitlement is 30 days plus 8 bank holiday
new year starts 01/04
if my last working day is in September.
Is it 2.5 days x 5 months (apr-aug)
or
2.5 days x 6 months (apr-sep)
many thanks

If your work is like mine they may give you 2.5 days x 5 and a bit months depending on when you are leaving - probably rounded down to the nearest half day. However, I believe legally they don't have to give you holiday for the part month as you get more holidays than the minimum.
But a banker, engaged at enormous expense,
Had the whole of their cash in his care.

They have to pro rata the statutory holidays at a minimum and they can't round down.

how they do the extras should be in the T&C's/holiday policy,

if you work on pro rata and negotiate if they try to give less.

probably easiest to work in weeks.

38 days would be 3.1666... per month

At our place, if you go past the 15th, you get that month's holiday entitlement.
    If you don't you don't

As all ready said though, if you're on minimum hols it may be different.

Do you have emploment contract \ handbook, that will confirm how exactly it is pro-ratad.. some might be based upon complete months.

Any reason that you are ending mid month? is it outside of your control? Is there payday cut-offs...

I'm guessing that as it's redundancy, it is outside their control

Survived my meeting and have spoken to ACAS to confirm.
The company will only give annual leave on complete months worked,
ACAS advised that as long as i am getting the minimum statuary amount then that is ok. The calculation in case anyone else needs to check is
28 divided by 46.4 multiply by weeks worked.

Many thanks to everyone that has commented

Did ACAS (or you) calculate what the statutory minimum would be given your holiday year. (I don't think you mentioned what the start of the year would be.) Unless you know that and take off holiday already taken, you won't know if you are being short changed.
