DRO and off-setting.
Options
Okay so im getting lots of different information from everyone and everywhere I look.
I have read posts on here by CCCS advisors and such stating that if I had a DRO and the moratorium period has expired that all the debts on the order are "discharged/wiped/cancelled/other words meaning the same.
So if my debt is discharged/other words. Then I have no debt. And the bank has no right to take money from me in any shape or form as a rusult of the previous debt
So does the banks off-setting rule over rule the legeslation that they can't take money towards my debts... seems like a legal loophole and contradictory. My dro says and legaly I have no debt, regardless of what records or anything natwest keeps and what ballance is on my account. I do not have to pay for that as it is discharged.
Would a solicitor speak to me regarding this??
What can I do to stop the bank off setting against debt that I dont legaly have... its just like they ignore the legeslation and law and do as they please.
When they lied and dicieved me by mis selling, did I have the right to cancel my loan? Or can I do that now... there must be a way to fight this. If not then its just like the rest of the 'system', it lets the big rich folk do what they want while poor people get ripped off?; then they try to get there ripped off money back.. only to find the bank allready has covered there back wih some off setting nonsence. If I lied on my loan application or anything id he breaking the law! Yet they do that, then say they will return your money, only to steal it again... id say our entire contract is void as they lied and decieved me, gave it me despite being on benefits most of my life due to mental illness. When my letter came saying they would refund I was very happy as you imagine, until I descover they are still keeping the cash that was paid illegality! Its like ... I go to the market wih 20quid and buy somthig, then return it the guy gives u 20quid and then charges u 20quid for returning the item... like regardless of what I owe them, they stole that money from me.. now I would like it back in full! As a cheque...
Im gunna stop ranting I need a ciggy......
Where do I stand what can I do?
Thankyou all and apologies for getting stressed and probably going on about useless stuff... im just mad! I feel like changing my name/adress and jus getting another loan by false pretenses and getting my revenge that way!!!!!!!! Grrrr

Did/will your bank account get put into the DRO - mine was and account was closed straight down, asked for card back, threat of account with legal services, can't get full answer because the Bank just replies further to your insolvency... the whole lot even though it was their mistake :mad::mad: took months for them to admit it was their error funnily enough only after the DRO - they paid creditor who also held account with same bank group noneother thus giving me a balance owe on this particular bank a/c whilst under going the DRO, now the account has been closed it was probably for the best as least it cannot happen again!
Can you close your a/c yourself if not already done? really seems to be the only 'safe' option when it comes to future offset - severing all ties, I imagine any refund is treated like PPI payout on an in debt account whilst in the moratorium period
Here is a positive - least poor people can qualify for DRO's? thank the lord for something
My only worry with the moratorium period is it says about 'being your protection during this time' as I'm getting closer to the anniversary date I'll soon be finding out what that means! watch this space!
Suppose you would have the Financial Ombudsman open to you as means of dispute? (after raising formal complaint to the bank) if you want to go down this route0
