Booked holiday and discovered not what i booked

Options
Hi
I booked a cruise in Thomson Travel shop, the TA got out the current brochure and showed us that the cruise we were interested in was adults only. as I work in education it appealed to us and we decided to book cruise. it leaves in a couple of weeks, but I found out today whilst reading the cruise forum people talking about children on the cruise we are booked on and I checked and there are in fact children on the cruise. the web page allows you to book!
first I rang Thomson customer services they would not speak to me as I booked with thomson travel shop. I rang them at store and although polite and understanding the upshot is they cant tell me where I stand on this matter until Monday when they speak to operations dept. they said the brochure I have and is current shows adults only. but earlier editions dont, and the fact that the TA did not put in her notes that adults only was important to us could mean we cant cancel with a refund and if we cancel we loose all our money.
what are our rights?
she even said that when a new brochure comes out it superceeds all other brochures, and the one we booked is the last brochure out.

Are you certain that the posters on the cruise forum are referring to the same date you are sailing?

Thomson do designate certain sailings as adults only although children are permitted on others.

We went earlier in the year and there were definitely no kids.

In the unlikely event that they have cocked up I wouldn't cancel but would see if they would knock £100 each off the price or offer a free upgrade to all inclusive.

Personally I think "the fact that the TA did not put in her notes that adults only was important to us could mean we cant cancel with a refund and if we cancel we loose all our money" is Thomson talking out of their backside.

It's clear you booked an adults only cruise, and you have the brochure to prove it. If, in fact, children are on the cruise I'd consider that a major change to the holiday and insist on a full refund. If it came down to it, I really couldn't see a court siding against you.

For info, there's details of 'major changes' on their site, in which case they state they will offer you a refund. http://www.thomson.co.uk/editorial/simply/terms/our-agreement.html
I'd insist that this is a major change.

Did the TA put in the notes that a boat was important? If not, by their logic, they could swap it for a tandem and you'd have no cause for complaint.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
  • hi yes 'I am sure its the same cruise date as others on the forum tested it out by trying to book online for the same date with children and it allowed them to right up to booking flight seats, yes I was shocked to see that to, tried it myself to prove to self.

my hubby looked through brochure and he said he considered it a manger change to like post above.

I have nothing against children, look at my name. 6 grandchildren and work with children, would just like a well earned break without them.

the time scale is a big factor as so soon to date:mad:

Thomson do offer one of their ships as adult only, but its only on certain dates.
It the edition of the brochure you booked or on your invoice does it state on the date you have booked that it is adult only.
'Children are not things to be moulded, but are people to be unfolded'
  • it shows it clearly on front page of the cruise calendar of the April edition, that Thomson celebration is adult only throughout most of July 2013 for the Crimean/ancient wonders cruise which is what we booked, we assumed it was because of the ports of call it was adults only. taking in sights of charge of light brigade etc

it doesn't show it on the invoice but I cant say I expected it to. having seen it in the brochure and verbally by the consultant in the shop
