Yes the wording is important. But....

Reading between the lines sounds like you are thinking about parking in a way that is blocking this driveway, partially.

Well if they actually brought a horse and cart home and wanted to get it up the driveway - it would be blocked and you would be in breach.

    Does that help?

Not sure if it`s totally inappropriate , but this made me laugh out loud ( at the same time as being i think , the actual answer being looked for!)

Just wondering if the access allowed the neighbours access ( right of way) fsays horse and cart say a meter wide could the op forbid the use of say a 1.3 meter wide car?

Obviously they would have to allow access for a cart and horse!

op would be great to see the wording .. From my side purely out of curiosity ..

Interesting to see what rights a row of this type actually give people.

Not really, I asked whether a car can be defined as a horse and cart. I have no issues with rights of access.

On our deeds, it states that we have the right to water our donkey at the neighbour's waterfall (yes - really). What this means is we can take water - but I believe that we don't actually have to have a donkey to do so. ;)

Honestly, don't buy the house. Your attitude will make your and your neighbour's lives a misery.

Oh, how I would love to see that :rotfl: Hopefully the neighbour is bloody-minded enough to do it.

There's some land to the rear of my property and a lane that runs along the side. I relation to both these, my deeds state that I have a right to
"cross and re-cross at any time, with or without cattle"

I've highlighted the without bit because had it not stated this, I'd probably have had to buy a cow . . .:rotfl:

robatwork has hit the nail on the head from the blindside

Essentially, there is nothing much you can do about this short of physically blocking the access. They would go to court and argue that they could not get their car on to their premises. You would argue they don't have rights for cars. A day and a half in court arguing about whether rights for a horse and cart cover cars ....

Their solicitor of the old school would probably suggest that they borrow a horse and cart which would eliminate the stupid argument about horses carts and cars and leave the court case simply about whether you were breaching the neighbours rights.

Your solicitor of the old school would tell you to consider what would happen if the neighbour brought up a horse and cart and then sued and tell you not to get on the wrong side of this.
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'
  • How about a compromise, during the summer they give your kids pony rides and in return you give them access?

I am told that the deeds state that the neighbour has right of access for a horse and cart (it's an old house :0).

With the price of petrol nowadays, you neighbour might not actually mind being forced to revert to a house and cart ;)
