Being harassed whilst awaiting a decision
bnedge
I received a parking fine, even though I paid and displayed a valid ticket and did not overstay and was fully in the designated area and have placed an appeal with POPLA and am still awaiting a decision. However, in the meantime, the company in question have taken to sending me threats of further action against me if I do not pay and are constantly raising the parking fine, which has gone up from £50 to £150 and they are threatening more.
I do not know what to do in this situation and would appreciate any help in the matter.
Thanks very much.

Which company was it?
Tell them you are awaiting a popla decision , that they are harrasing you and are in breach of the BPA COP
Did you get help sorting your appeal stuff out, i hope u appealed on legal/contract grounds
Oh its not a fine.
And even if you lose you are aware that you dont have to pay this invoice?Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
I wasn't aware that I didn't have to pay their "Invoice". An interesting use of terms, please do tell me more
Thank you for your reply.
Essentially, it was Vinci Park, and they claim that they couldn't see my ticket, even though it was in plain view, and the "evidence" that they sent to me was taken from, shall we say unusual distances and angles that don't clearly show my dashboard.0 -
Agh right so you have appealed on "the first person what happened on the day" rather then contract issues etc.
Well thats all it is at the end of the day, an invoice that you can pay or ignore it is not a real parking ticket)
So if Popla turn down your appeal (which they may well do) then just ignore Vinci.Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -
Please add the demands for payment from this company to the popla appeal, just scan in the paperwork and tell popla that this company is harassing you for payment, quite contrary to the BPA Code of PracticeWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Oh dear, I am concerned as you are a newbie who hasn't previously asked for advice on how to word a POPLA appeal. What did your POPLA appeal say? Can you explain what contravention the PPC reckoned you had committed? We have a certain suggested wording which wins and we know that normal appeals are far less likely to win and mitigation has no chance.
What I would do as the PPC is harassing you when they should not, is take this chance to send further information to POPLA including further appeal points if they weren't as comprehensive as the example POPLA appeals I showed this poster, have a read of the links in post #15:

Don't panic if your appeal had none of those strong grounds but we really really would suggest you add them sharpish!!!!! Also you can take some copies of the debt collector letters as well and send them to POPLA with your extra appeal points, one of which will be that the Operator has breached the BPA Code of Practice in not 'stopping work' on the case whilst the POPLA decision is pending. Read the BPA CoP to find the paragraph in question and to look for other breaches if you never listed them in your first appeal (you really should have).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Report them to the BPA and the DVLA that's a serious breach of the code of practice.0
