POPLA Lead Adjudicator annual report

First, let me apologise if this has already cropped up as I was on holiday at the beginning of June.

But, as per thread title, the Lead Adjudicator has now produced POPLA's first annual operational report and very interesting it is.

It even covers VCS-v- HMRC and POPLA's stance there. Also covers mitigation and a host more.

Read for yourself and, anyone who is about to write a POPLA appeal, or even considering it, please read this for guidance.

Also - and c-m won't like this, there is a section on Blue Badges that don't bode well for those disabled motorists whose blue badge has either slipped or not been displayed. POPLA says "tough luck - your appeal is denied" or words to that effect.

But good news for those who stopped on yellow lines at airports - at least potentially. (Signs must be able to be read without having to stop)

Plus at the end, number of appeals, wins, losses by PPC !!!

    And it's okay to discriminate against people who are disabled under the 2010 Equality act but don't happen to have a blue badge............

    'In fact, parking spaces frequently are provided on private land for Blue Badge holders, for example in retail parks and shopping centres. Such provision is in itself perfectly reasonable and may be one of the conditions of parking. If a bay is reserved for vehicles displaying a valid Blue Badge, then only such vehicles should park there, provided the restriction is clear to the motorist.'

    You can debate this till the cows come home ( and I am on your side), but the point of this thread was "know your enemy" so to speak. If there is a POPLA guide to what wins and loses - and I think this is a good mini-manual, then we know what not to waste time on and what to concentrate on.

    The report reaffirms what many contributors have already concluded but has some other interesting pointers.

    What are these "penalty charges" they keep referring to?

    The report was covered a couple of weeks ago. I checked the arithmetic on their figures (above) - they couldn't even get those right. I posted on here and pepipoo about it. If they can't do basic arithmetic what chance have they got to get anything like the Equality Act right. Oh dear!

    Still believe that the report will influence current advice being given on appeals.
