Hey Sony! Where's the rest of my memory?

Just treated myself to a waterproof mp3 player (swimming can be boring). It's a Sony NWZ-W273 - 4GB.
However upon linking it to my laptop I find that it only has 3.54GB!
Is this fair?

Hard disks and SD type disks which this is are specified as 1000B = 1KB, 1000KB = 1MB and 1000MB = 1GB. Windows counts and reports using binary style K M and G so 1024B = 1KB etc. The result is that hard disks, USB drives, MP3 players etc. always look like they are less than you might expect.0

You technically never receive the full memory capacity, due to the reason that some of the memory is used to store the 'operating system' to manage playlist and firmware updates.0

Haven't used it yet. I saw a comment on another forum recommending Zog's ear putty.....or something similar.0
