I would question if they could enforce the account fee, particularly if the OP doesn't use any feature not available on the standard basic account.
Those T&Cs are usually for upgrading/downgrading accounts not for providing unsolicited features like iphone insurance - I have no doubt the FOS & FCA would take a similar view.It doesn't say there that they can convert you to a chargeable product, or to a product that costs more than your previous one, without your prior consent. I just opened a select account with them and so far they are an absolute shambles.
Told me to have a debit card/passport for verification ready when i applied online, then didnt ask for it and told me to go in branch.
Went in branch asked if they needed my signature they said no then sent me a letter asking for it.
Sent me a 2nd rate debit card rather than the online/offline contactless one
Then sent me a letter telling me as i hadnt complted the activation process in 28 days it had been closed, even though i have my card pin etc and it still hasnt been 28 days since i applied
Online banking take 24 hours to work
I had to active my debit card by text, got a text back saying it was activated, then another one saying i couldnt active by text
Then when i phoned she said i may need a card reader to make faster payments on the app. Really want to carry that in my suit pocket everywhere
In summary will prob never use and wish i didnt waste a credit search0 -

Sounds like NatWest to me. Easily one of the most lengthy and disjointed account opening processes of any major bank by far in my experience.I don't believe this for a minute actually. There's definitely more to this than appears.

Its the norm it cracks me up though as the amount of people that moan about banks not upgrading there accounts its a right catch 22 for these poor banks.

I don't believe there are very many people who have ever moaned about not getting an upgrade to an account that will cost them a monthly fee (which is the issue in this thread).
As an aside, it's their accounts, not there, and "it's" rather than "its". Nevva mind.0 -
That the bank are doing some sort of auto-upgrade that you have to opt out of.
To be fair I do not believe an account could have been upgraded from a basic one as they would have Z markers on there profile which would prevent an upgrade. I agree, it is very hard to believe. But apparently they do. May be it would help if we could see scans of the letters they sent to the "victims" of these unwanted upgrades (with personal information blanked out, of course).0
