Has anyone here ended up just sticking 'two fingers' up to the DCA?

Hi all,

Five years ago I split with my wife and ended up funding two homes. I also took all the debt and the ex took all the assets and I couldn't keep up with the credit card and loan we had with MBNA.

Since then I've been hounded by 1st Credit, who purchased the 16K debt from MBNA.

However, now I'm in a position to pay. I'm self-employed - business is going well - and my partner of four years has just received a 'life changing' inheritance.

I could pay off my debt! We've just bought a house (in her name only; though I will be paying the remaining amount of the mortgage (she put a massive down-payment down)).

I think had they been more sympathetic to my plight earlier on, didn't hound me for extra cash which I paid when I should've paid more priority debts, then I would pay them off.

But now I just feel like sticking the proverbial 'two fingers' up to 1st Credit, who're a bunch of 'illegitimate children'.

I honestly don't care what they do to me; I ignore all their phone calls and letters; I think they can't really touch me; and they refuse to bankcrupt me also.

What's your views on my stance?

    Hi Tosh,
    I have to be carefull what i say.If that is what you feel then go for it.The likley hood of 1st credit persuing the debt through courts would be minable.Bearing in mind that they would have paid a pitence for the debt so spending over £1000,to try to get there money back i dont think so.

    They will, especially if you own a property to put a 'charge' on it, but they won't take you to court to bankcrupt you; that costs them money.

    They still may take me to court for a CCJ or an IVA though (I think), but other than that they can't touch me; and rightly-or-wrongly; I'm self-employed, working in a mainly cash-industry; so I can state what my earnings are. Whether I tell the truth or not is upto me!

    The thing is, had they not been so aggessive/nasty/harrassing in the first place, I just may have coughed up when I could.

    But I'm really cross with the stress and pressure I was put upon by them; even suicidal at one point.

    So now I think stuff 'em.

    Sorry to ressurect an old post (my post), but I think it's usefull.

    Since my original post about just ignoring the DCA's I think I've had three phone calls to my mobile, which I just hung-up and switch off; and a number of text messages from Mackenzie Hall!

    But nothing other than that! I've not made a payment to them in over three years and nothing has happened.

    They have left me alone otherwise! I haven't heard from them in months.

    Who else has just ignored your DCAs and they've just 'gone away'? I can't be the only one.

    The same for my Missis too; although her debt was far smaller than mine.

    Out of interest, tosh, when was the last time that you actually made any payment towards, or acknowledged, in writing, this 'debt'?
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

    Rog,

    I'm not really sure, but I reckon it must be about five years ago. At the time I just couldn't; I had priority debt that needed paying.

    Now I can pay, I won't; had 1st Credit been a bit more sympathetic, rather than threatening me constantly when things were extremely tough, financially, then they may have had a different result from me.

    I also have a problem with the ethos of a business who preys on others misfortunes.

    Anyway, why the question? Have you some good news for me?

    I ignore all phone calls from DCA's. I'm paying them what I can afford via my DMP and I have no desire to be bullied and harrassed to pay more when I can't. I do have property and there is always a risk that the could go for a charging order but I shall worry about that if and when it happens.

    1st Credit were one of my worst also. I just ignored their phone calls and carried on paying what I could afford. They've been quiet with me for a while now but I expect they will kick off again soon, but I shall just continue to ignore them.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
  • i would ignore they wont take to court they have bought your debt your selfemployed oooooh they can phone your boss , lets face it there stuffed you do not pay there shafted .

    Tosh - I think Rog was wondering if the debt could possibly be statute barred. Think its 5 years and 6 is england and wales from last payment of written acknowledgment of the 'debt'

    I've heard this somewhere, maybe on this forum, but wasn't sure how it works.

    However, if it is the case that after six years of not paying or acknowledging the debt, then 'they' can't touch you, then I must be approaching that time limit.

    But it can't be that easy, can it?

    And that aside, they're making no real effort to chase me; I reckon they're really busy with people they know they can bully, and they target their resources towards the more vulnerable; so statute barred or not; I'm not really worried.

    I guess my real motive for posting this in the first place is that I have this illogical hatred for 1st Credit, and it's my token effort at 'having a bit of revenge' back at them.
