This is the lettter i received this morning from MBNA...
Usual thanks for the letter you sent onto our findings.....
You took out the credit card on 6 dec 2007
You were sold PPI over the telephone on 6 dec 2007
at the time you stated that you had been employed as a sales assistant for 2 years
We have been able to review the information that our associates were required to give you at the time, from which is clear that your sale was given on a non-advised basis.
You have said that the policy was not suitable for your needs. Since no advice was given, our associates were not required to ask whether you had any existing insurance in place, collate (collect?) any information about your demands, needs and circumstances and nor did we have a duty to ensure the policy was suitable for you. However we were required to give you information which was adequate for you to make an informed decision about whether or not you wished to purchase the policy.
The information that our associates were required to give you at the time of the sale required them to set out the terms and conditions of the policy, eligibility details, the main exclusions and details of the 30 day cancellation period. In addition, you were sent a policy summary and full policy terms and conditions after the call. The policy summary set out the eligibility for the policy, the benefits of the policy, the main exclusions and the cancellation terms. The full policy document provided further comprehensive information. As such, i consider it more likely than not that your information needs were met.
You have said you felt pressured to purchase the PPI. However at the time of the sale, our associates were required to inform you that the policy was optional and to gain your consent (does not mean that they actually made it clear to me) I therefore take the view that our associate would have make you aware the policy was optional and was being added to the account.
You stated in your questionaire that you could have relied upon your partner to meet your repayments in the event that you were unable to work through accident, sickness or unemployment (Made redundant in 2009-no missed payments i kept up with them, no help from MBNA) However, during our telephone conversation you confirmed that they did not have any savings at the date of the sale.
I am not therefore persuaded that your partners circumstances would have made it such that your repayments would have been fully met.
I note your comment in the questionaire that you were not informed about the cancellation process. Having concluded my investigation into this matter, i would like to take this opportunity to outline my findings.
I have come to the conclusion that if any key features that you say were not fully explained to you had been fully explained, this would not have affected your decision to take out the policy based on your circumstances at the time. I have considered the other cover and funds that you have said that you had available comprising of your partners help. I note that you would have still received significant benefit from this policy in the event of unemployment etc (funny how i received no help when i was made unemployed!)
I regret to inform you that i am unable to uphold your complaint blah blah......
So i was made redundant in 2009, i received no help from mbna and still kept up my repayments, i did ask for paperwork to claim on the ppi and remember that for some reason i didnt go through with it, had to be unemployed for x time to make a claim or something on it wasnt right for me, im sure i moved all the money off the credit card after this to escape the ppi, as i thought i had to keep it til the balance was cleared. Should i take this to the Financial Ombudsman? Im not that good at writing letters or getting my point across, can anyone advise me what to do next? Or how to write out my complaint please. Or even if i should just leave it?
