Did your freind (or even you) use these forums to create and/or review the POPLA appeal, despite coming here in plenty of time to do so? It would appear not, which is probably their downfall.MilgramsMate wrote: »Hi I've just received an update regarding my friends claim.
Her appeal has been overturned by POPLA. Does anyone know if there is an appeals process especially as she only received a notice to keeper two months after the alledged infringement?
Although there is photographic evidence of a PCN on the windscreen of the car on that day, surely they'd need to send the notice by Recorded/Special delivery to prove that the notice was within the 56 day time frame as specified by schedule 4 of the POFA 2012 detailed by Guys Dad above?
she's now got 14 days to send £100!
Who says they have to send £100? If the POPLA rejection says that, then it is seriously out of order.
POPLA decisions are not binding on the motorist. So the best thing to do now is simply to ignore all the threats from now on.0 -

Please can you post the full decision (with names redacted) on this thread or the sticky thread. Even though you lost, the decision will help others in the future.
The operator does not need to use recorded delivery. POFA 2012 states that delivery will be deemed to happen 2 working days after posting first class.
POPLA don't do appeals, but you can complain to the Lead Adjudicator. I have 4 complaints in at the moment, and recently I was assured by the Tribunal Manager that the Lead Assessor was reviewng my complaints and that the Tribunal Manager had prodded him to get a move on. I expect a reply any month now. I do not expect the appeal results to be overturned though; I'm not sure POPLA can do that. I do expect him to find that the assessor acted incorrectly, and to correct their actions for future cases, which I will use if any of the operators have the balls to take me to court.
None have so far.
Perhaps this was due to the robust letter I wrote to them, which followed xxxlazyDaisys advice and warned them that I would not be paying without a court order, and therefore not to harass me with debt collectors but to put up or shut up...and to follow practice directions by first writing me a letter before claim which contained all the information xxxLazyDaisy specified.Hi, we’ve approved your signature. Hi all
I've received a parking charge notice from PPS (Premier Parking Solutions). I've appealed to PPS on the basis that I have the ticket - it had blown into the bottom of the dashboard when I shut the door.
They have responded saying that they uphold the original decision, and have given me details of POPLA.
I feel it's unjust to have to pay £60 (or £100 if not paid soon), but don't want to risk POPLA rejecting it (on the basis that the carpark sign told me to display my ticket appropriately) and then PPS taking me to court, where I might have to pay more than that in costs.
So, my questions are: how likely it is that: 1) POPLA will reject the appeal (it seems to me quite likely based on other posts, and my phone conversation with someone at POPLA); 2) PPS take it to court if POPLA reject it; 3) a court would make me pay charge + costs?
Would really appreciate any advice based on experience / law. Many thanks0 -
You really should START YOUR OWN THREAD, not just hijack someone elses and confuse people, however....
you will win at popla if you follow all the advice here:
http://www.parkingcowboys.co.uk/popla/
have a read and work your appeal based on that guide.
POPLA will NOT reject your appeal if you base your appeal as per the above link. So dont worry about courtProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0 -

14,000 appeals so far. Less than half found for the motorist. Despite what the next post says, there is no assurance of success while BPA is the funder of POOPLA.0 -

Before you follow Fireman Bill's advice or his alter ego, Scouse Magic, please read some of his/their earlier posts and ask yourself the questions

You will 100% definitely lose if you appeal again to POPLA in the same way as highlighted in red.
You will 100% likely win if you follow our POPLA advice:

Easy. You don't even need a new thread except to report when the POPLA appeal wins.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
