Dvla failure to notify disposal of vehicle - lease car

Hi,

I recently returned my VW Passat CC to VW which was on a PCP lease. On the paperwork received from VW it clearly states that I need to give the V5 certificate to them on collection

"On collection of the vehicle you will be asked to supply the V5 Registered Keepers Certificate. This must be the new style V5 as old log books are no longer.

If the V5 has been lost, you should obtain a replacement from the DVLA by calling the V5 hotline on 08702400010. A charge of £250 will be made if the V5 is unavailable when the vehicle is collected"

I have now received a letter from the DVLA asking me to pay an out of court settlement for failure to notify them of disposal of the vehicle!

I have the receipt from VW when they collected the car, however they haven't ticked the box for receiving the V5, which is annoying as they definitely got it!

What do you think I should do, pay the fine, or send off all of the corroborating evidence (letter from VW asking for the V5 and the collection receipt?!)

I really don't want to pay this given I don't see that I have done anything wrong!!!

    firstly dont pay dvla anything.
    send a letter telling then it was surrendered to VW finance/leasing on what ever date they picked it up.
    send a photocopy of the collection receipt and the letter saying the v5 goes with the car.
    you really should of got the fella collecting to fill in the yellow bit of the v5 but hindsight is a wonderful thing.

    As above, if you and the person collecting the car didn't complete the yellow 'Transferred to the trade' part of the V5C, and you did not send it to DVLA, that is why they are claiming you did not notify them and are are liable.

    The company collecting it were not VW, so didn't know any of the details for the new owner etc...

    As you were returning it to the trade - VW, it is their detals that should be on the form.

    There is a different part of the V5C to complete if it is to a new owner.
