car accident claim please advise

My boyfriend's car was hit from behind on Friday. Other driver admitted responsibility. His car has been written off and his insurance has said they don't offer to sell back the salvage. He has whiplash and a trapped nerve in his back. He has free legal advice with his insurance but they have not yet been in touch. Accident advice helpline have phoned him telling him to use them not his free legal advice as using the free advice will put next years insurance up. As aah will take 25% of his compensation I think he will still be better off going through his own insurance company. Any advice please as he is very confused.

    I'd use the insurance legal help I'd already paid for. The independent company just want to sell their services and get a nice cut of what seems like a cut n dried case.

    It's unlikely the insurance company would increase next year's premium just because he utilised the legal service especially as the other party has admitted responsibility. All costs should be passed on to the other party & their insurer. Your other half can shop around for new insurance next year if he didn't like the renewal premium offer.

    Make sure the other party's admission is in writing then work with your insurer and the other party's insurer.

    If he cancels his claim with his own insurer and claims for his car off the third party insurer then they will let him buy back his car at a nominal charge which they will deduct from the settlement.

    There are other advantages in not claiming off your own policy (no excess deducted to reclaim, no temporary loss of ncd which can cause problems if your renewal comes due whilst the case is concluded).

    Accident advice may have mislead him. Using your legal expenses won't affect the premium.

    It is highly likely (subject to the policy wording) that his legal advice won't make any charge to your bf for pursuing his compensation. He should check that it provides representation, and isn't just a telephone advice line!
