PPI claim - Fobbed off letter

Hi
I recently used SAR form to write to Lloyds in order to try and establish if I paid PPI on my credit card over the last few years. The response I got does not make it clear at all I am now wondering if I have been fobbed off or if I am missing something in their jargon. The response was:

"I write in response to your request for a copy of your consumer credit agreement under section 78 of the Consumer Credit Act 1974 (CCA).

I have enclosed with this letter a copy of the reconstituted version of your agreement and a signed statement of your account. By providing you with the documents attached to this letter, we have satisfied our obligation to provide a copy of the executed agreement under section 78. There is no requirement under the CCA to provide you with a copy of the original signed agreement. We are endeavouring to locate the copy of your signed agreement but please be assured we would not have opened a credit card account without having sight of a signed agreement. For the avoidance of any doubt, we have set out in the appendix to this letter your rights under section 78."

The letter goes on with lots of legal explanations.

The copy CCA enclosed seems to be a generic one and does not mention any interest levels or PPI.

I still have no idea if I paid PPI on the credit card.

Any assistance would be greatly appreciated. I am trying avoid going to a 3rd party to make the claim on behalf.

Andrew

Can't you check your statements? If you did, it'll be on every one with an outstanding balance. Or phone and ask.

Then write back to them and tell them they have not complied with the SAR letter you sent, you want ALL of your information, and that if they do not comply, you will complain to the ICO [Information Commssioners Office] Give them a couple of weeks to get back to you, if they don't, complain to the ICO and they will force them to comply.

Send them a copy of the SAR letter with date on it, remind them they had 40 days to get back to you and that they have cashed the cheque.

It wouldnt do. PPI doesnt appear on credit card agreements.
I still have no idea if I paid PPI on the credit card.

Asking for a copy of the agreement isnt going to help. You could just ask them straight out though.

Forgot to say [just in case] see the version of the SAR template on the front page for an example....except for the bits about proving they've destroyed documents, they don't have to do that.
