Ex partner defaulting

I have a joint mortgage with an ex boyfriend on a property he has taken responsibility to pay the mortgage on but is regularly defaulting on. I have another property also in a joint mortgage with the same ex. I live in this property and have never defaulted on my mortgage payments. A Deed of Trust was drawn up with my solicitor when we broke up stating his duty to cover all payments on one property and I on another. However, the building society sends both of us regular letters and sometimes calls saying a month or two payments were not met. I cannot afford to buy him out and am now stuck with appalling credit rating due to his defaults. He also refuses to sell or buy me out. Is there anything I can do?

If he cannot afford to pay mortgage then he cannot stay there. If you cannot afford to pay the arrears then you will need to take him to court to force sale. But as the property you live in is jointly owned as well you will probably need to put that on market so you can both move on and start again seperately. Is there any equity in either house? Mortgage companies generally start repossession if 3 payments are missed. Can mortgage on house he lives in be changed to interest only to stop repossession or can he take in lodger?0

He doesn't live in the property and has a tenant as far as I know but spends all his money elsewhere. There is little or no equity in the house and is on an interest only mortgage. The mortgage company who are very sympathetic to my dilemma and I pursue him to pay up regularly.0

Can you get tenant to pay you directly and then you use this money to pay mortgage?0
