    If you have paperwork confirming what you say you ordered, I suspect this will push the balance of probabilities in your favour when trying to convince a judge what was ordered and what they have failed to provide.

    I'd make it clear to them you consider them in breach of contract and if they do not seek to provide what was ordered you will be seeking a refund via the small claims court.

    Make it clear you are serious and will not compromise and it should get their attention.

    A solicitor will cost more than the claim, so hold back a second. Any legal claim should be small claims court via moneyclaim online.

    The album, can you show what albums similar to what you thought you ordered generally cost compared with what you paid and you received? Could you show that the amount you paid you had a reasonable expectation of what you wanted?

    If they have ceased trading, were they a sole trader or limited company?

    You state the company is no longer trading - was it a Ltd company?

    Before you go to court, exhaust trying to come to a negotiated agreement. If it is your word against theirs, what do you expect a judge to do? You could be saying 'they promised a solid gold helicopter for £50', but with absolutely no backup, they'll consider this more likely to be a misunderstanding than a commitment.

    Strike out the 'emotional stress' nonsense, small claims cover out of pocket expenses. Be very precise, and be aware even if the judge finds for you, you may still have a tough time getting money from an individual if they have none.
