Parking ticket to park in my own car park!

We rent an apartment and pay £80 a month for the use of the Apartments private car park.

On two occasions we parked in the car park. However instead of parking inside an allocated space, we parked up against a wall in the car park. Parking where we did does not block an exit nor does it block an entrance. And ever since we have been here someone or the other has always parked in that space and we have never ever seen anyone else get a parking ticket for doing so.

After having parked there late at night we received a ticket at 2am! Stating we parked outside an allocated space and therefore we had to pay a £90 penalty fee as there is a clear notice to say we have to park within a bay.

Surely this can't be fair or reasonable; when we pay £80 for use of this private car park. Whether we park in a bay or just outside the bay - 100% does not effect anyone elses use or ease of use of the car park. I don't see the basis upon which we can be fined?

Any help would be gratefully apreciated, as we have ignored a few letters but are now getting a bit worried. :(

    check lease etc to see if you have an allocated space or just the use of A space. Which ppc is it.
    ps You have not been fined, just sent an invoice which you can ignore if appropriate.

    Hi,

    I just saw the replies. Is there a way i can get a notification when someone replies to this thread?

    We rent a flat in the block and rent a parking space from another flat owner who purchased the space when he bought his flat from the developers. There are around 45 allocated spaces and we all have a permit badge to show that we have a right to park in the car park.

    If the landlord purchased a space, who charges for the parking? Just curious.

    Our landlord did not get a parking space with his flat. The parking space we use belongs to another flat owner. He charges us £80 a month to use that space.

    He owns the parking space but not the land, which is what the parking tickets argument is; that the land is privately owned just the use of any of the parking spaces is allowed per permit holder.

    I will check when I go home tonight who the company issuing the ticket is.

    Did they really say "penalty"? I bet not. People really should be more careful when trying to relay important information on this forum :-)

    From what you've said, it seems the PPC are alleging either breach of some contract or other, or trespass, as you were on land you haven't been invited onto. Either way, only actual losses to the landowner or damages can be demanded, both of which would be zero.
