Smart Parking East Kilbride Olympia/Sainsburys

Just received PARKING CHARGE NOTICE from Smart Parking relating to my vehicle (I'm the keeper not the driver).

Relates to beginning of May... Discount period has expired and they seek £70.00...

No intention of paying.
For what it's worth, this is the first communication relating to the alleged incident. Apparently these scammers don't even 'ticket' the windscreen so it's hardly surprising that we have 'missed' the opportunity to pay during the discount period...

I note that I may 'appeal' as long as I provide a copy of the Pay and Display ticket - from six weeks ago, right?
I think it's more than likely that if my wife had found a yellow envelope on the windscreen that she would have made a point of saving the P'n'D sticker to prove her 'innocence'.

I'm also advised that if the incident related to an overstay in a retail car park, as a 'genuine customer of the retail park' I may provide copy receipts for appeal consideration... again - from six weeks ago?

Maybe it's just me, but I don't have a collection of retail receipts for groceries from weeks ago...

This is such BS. I do hope other East Kilbride shoppers ignore this crowd...

(I should say we DO Pay and Display for the dubious privilege of our shopping or cinema going in East Kilbride, and we do NOT overstay time purchased, so cannot fathom this...)

Ignore it as it's Scotland. DO NOT RESPOND as they need to know who was driving in Scotland and if you do not reply to the scary letters then they have no case.

But always complain to the retail Store Manager, this harassment of customers flies in the face of customer service (and sometimes a Store Manager will cancel these fake PCNs).

The only thing I'll say about that car park is that the signage is VERY clear.

Is it possible the PnD sticker fell off? Or was placed somewhere not immediately obvious? (I always put mine either on the windscreen on the driver's side, or on the driver's side door window).

Neither situation explains the lack of a NTD ticket though. (Unless your wife is too embarrassed to admit it).

Who cares what happened, no-one should try to blame themselves for this scam fake ticket. All fake PCNs are a waste of paper and in Scotland the advice is simply to ignore it.

Anyone can get a fake PCN - even you or me - if a P&D ticket slips down or if the scammer takes a pic of the front windscreen only when you've put it on the driver's side window. On this forum we have seen that sort of sharp practice posted about, seen it all in fact, any excuse on the part of the PPC scammer and any law-abiding person can find themselves in possession of a fake PCN.

These are not firms that anyone should be paying (or responding to at all if in Scotland) and as for 'very clear' signs, well I have not seen a compliant or clear PPC sign posted on forums in years. Certainly not one that forms a fair contract and would stand up to a defence if ever the PPC tried a small claim.

On this forum we have seen LOTS of examples of Smart Parking's signs = NOT compliant with the BPA CoP (English or Scottish version), and we have seen a LOT of their postal Notices = NOT compliant either. So this isn't a firm to be taking seriously.
