I am sure most of us saw the sad news about one of the Liverpool Duckmarines going under at the weekend.
I am curious to know what sort of insurance protection the passengers would have had. It appears most were taken to hospital although all have been released now.

Those type of terms do not remove any legal rights that people would have. Any passenger carrying vehicle would have to have relevant public liability insurance and it is against this that you would make a claim. There are links to Insurance documents on the site you have provided a link for. Liability cover up to £5m per vessel. Does not seem enough.
The Marchioness ferry disaster comes to mind, but I have not studied any Insurance/liability issues. If you are interested, perhaps search the internet to see what you can find.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

They should claim for getting wet, loss of enjoyment, shock, time spent in hospital, damage to property, any psychiatric repercussions etc etc.
"Where there's blame there's a claim" will trump their unenforceable conditions.
And Liverpudlians are involved, so don't expect them to meekly accept there's "nothing to claim"!0 -
One would hope that nobody, Liverpudlian or otherwise, would be talked out of a valid claim for compensation by either unenforceable T&C on the boat or the anti-compo brigade on MSE
Interesting (worrying??) to see the poor standard of their risk assessment http://www.theyellowduckmarine.co.uk/uploadedfiles/documents/RiskAssessment.pdf which hasn't been updated since 2009 and doesn't actually cover the vehicle sinking despite a similar thing happening a few months ago.
On the bright side, according to their T&C yellow duck will give all passengers a 50% refund because the tour wasn't completed0 -
Hi, thanks very much for all of your comments. I had seen the document regarding £5 million per vehicle/vessel but assumed that was for if they crashed into someone else. Very interesting. As one poster said they only got wet lol But what about all their phones or other valuables 31 people will add up to quite a claim.
