Insurance Replacement Broken

Bit of a long story, but I will try and keep it short

  • I received a very expensive new mountain bike in September 2012, I say received as it was an insurance replacement for a similar bike, the frame is manufactured from Carbon
  • I have used the bike 4 times and it has covered 150 miles (mainly due to the bad weather we have been experiencing).
  • When cleaning it I noticed a crack in the chainstay
  • I contacted the supplier who requested photos of the damaged area, which I supplied
  • The manufacturer have confirmed they will provide me a replacement part, and thus I assume they have confirmed the part is faulty, however this is where I am starting to struggle
  • The replacement part they have offered is a different colour to the rest of the frame and will look awful
  • I am not sure the replacement part is actually the correct part as the year the bike was manufactured the bike was never offered in the colour being offered.
  • I have gone back to the supplier to state that an alternative colour is not acceptable and that I am not sure it’s the correct part anyway
  • The suppler and manufacturer are in discussion
  • At the moment I am happy they appear to be trying to resolve the situation although I am unhappy about how long it is taking
What I reallywant to know is where do I stand and what can I ask for/expect to rectify this situation

  • Is a replacement part of another colour acceptable?
  • Am I within my right to ask for a part of the same colour and in particular same specification (potentially the item in the wrong colour may have been manufactured in an inferior carbon fibre?)
  • If they cannot supply a replacement part can I request a complete frame?
  • I really don’t want a refund as I love the bike and obviously I am not sure where I would stand with respect to a refund as it was an insurance replacement so I paid a minimal amount including excess and a payment to get the specification I wanted.
Any assistance to help me understand my rights are would be gratefully received

    (No wonder I am not sure what I should be asking for)

    If the supplier was arranged by your Insurer then you're Insurer is liable to correct any relevant problems.

    Ring your Insurers up and politely advise them you want the issue resolved quickly to avoid an official complaint
