Entitlement to refund

Options
I bough two pairs of shoes from the same shop and of the same make. I wore one pair and they hurt so much I will probably never wear them again. The shoes were very similar in style, with the same heal height and toe (which is where it hurt). If I return the second unworn pair - is it a un-refundable change of mind, or an un-fit for purpose, I'm entitled to my money back? Although I've been told the shoes will wear in, they are evening shoes, I won't wear them often and don't want to ruin anymore nights out by wearing painful shoes. Does anyone know - am I entitled to a refund, yes or no?

Hi, pretty sure you don't have the right of a refund, but I sympathise!
They are suitable for purpose, just not for you.
Were they okay in the shop? You can try to return them - the shop may have a policy that means you will be refunded or get an exchange/credit. Worth a try!

    Good luck x

It depends if they are badly designed or just not suitable for you.

It's a change of mind. They might not fit well, but they're not actually faulty.

You have no automatic right but there is nothing to stop you asking.
Take them back, with your receipt and explain about the other pair and just see what they say. Of course it would also be dependant on when you bought them because you didn't mention that in your post.

    Other than that, it's ebay....
make the most of it, we are only here for the weekend.
and we will never, ever return.

Not necessarily. Pair 1 she is arguing were not fit for purpose/satisfactory quality and she is extrapolating that to pair 2.

But the problem with mass produced items is showing that its not just you who is having the problem.

OP could always say well you can refund me now, or I will wear them for 4 weeks and then come back for a refund.

That being said, if they take a few wears to wear in then that is not a great reason to return them.

How much did you pay per pair?

Rather than wearing them in on a night out, do what sane & normal people do - break them in at home, no ruined night out & problem more or less sorted.

I wouldn't say you had a case for a refund here, you can try but I'd expect a negative response.

Depending on which shop you bought them from and when you bought them, you might get a refund on the 2nd pair (as some shops do offer refunds if you simply change your mind about a purchase but that is over and above what SOGA says you are entitled to), but based on the fact that they are not comfortable for you doesn't give you a legal right to a refund for that reason.
