    This is unlike Amazon. I've just had a look at this marketplace seller's FAQs and terms & conditions. They are not in accordance with UK consumer law.

    Amazon have rejected the A-Z Guarantee as you're out of time for that process, but the Sales of Goods Act does apply. It might sadly mean taking the seller to the small claims court, but I'd certainly alert Amazon to the way that trader is doing business as IMO it reflects badly on Amazon to have sellers like that.

    Has the camera been investigated by anyone yet? Has a warranty claim been refused on the grounds below:- Have you dropped it, got it wet, got it covered in sand?

    Why should the OP put in a warranty claim? They don't need anyone to "investigate" it. They've used the camera once and now it's faulty. They should be entitled to a full refund from the seller.

    Not if they have damaged the camera. The seller has the right to inspect the camera.

    I was asking because it is not clear it has got that far (seller stonewalling by the sounds of it), I don't think it has but you never know.
  • Amazon rejected due to the 14day rule, although it had only been 3 to 3 n half weeks tops.
    I have put a complaint in to them and am awaiting a call back.
    After more investigating, it looks as though this seller has been doing this to quite a few people. I now have all his company details, VAT number (UK Registered), Bussiness address and parent company name. Going to report all of this the office of fair trading and see what happens.
    Just to clarify. The fault was not down to miss-use and we have explained this to Amazon and the seller, We did try reasoning with the seller before Stating the law and threatening legal action, but still no results. But on a good note it has all been done through email, so I have all the proof I need and I will not let this go!!

    I have had a similar problem with a seller on Amazon. Seller told me that is must be because I had mistreated the item, which I hadn't and the seller has no evidence to suggest I had, and Amazon have reject the A-Z Guarantee.
