Can we sell privately while within EA contract?

sorry didn't mean to crash into this thread! thought was posting a new one...0

Can someone tell me how much notice I'd need to give my EA who I am on sole agency agreement with for 6 weeks to terminate contract and then sell through another agent once this has expired without any recourse from initial EA trying to claim fees.
Contract says either party need to put in writing termination of contract within 2 weeks of expiry date, will this ensure they won't attempt to sue me if I subsequently sell with another EA later down the line?
Thanks,
If you write and your notice is received by the agent 4 weeks from the commencement date, then the contract will end after 6 weeks (2 weeks later)0 -
Great thanks, so just for clarity, if it commenced Thurs 6th June I'd have to get termination letter to them by Thurs 4th July to leave a full 2 weeks until termination. sorry if being dumb just want to be clear!0

Think you'll find agent will tell you/probably sue you for his agreed % even so...
If you sign up for a contract you should expect to honour it's terms...
To be fair to the OP, they haven't offered to sell privately to any buyers introduced by the EA, so not in breach of contract.
Doesnt mean they won't try to ge their cut, but i wouldn't say based on that, that there is a breach of contract0 -

I'm not trying to go back on my contract or anything. It's just that the EA haven't managed to sell it, yet anyway, and they are the most expensive on the market I think. I chose them because they have a good reputation for selling property fast and getting the asking price, it's just that they haven't managed to sell mine yet...0

Thanks Tortoiseshellcat sounds like neither of us have good EAs!
With mine its an issue re loss of trust, strongly think they're trying to position me into selling underprice to an EA associate in one of their other offices, and I am being subtly coerced (or so they think!) to go with her asking price offer, which was put down before I even had others even get a chance to walk thru the door!! As paying only minimal commission as under £200k, its not a ruse to up others offers, but def attempt to get mates rates!! Flippin cheek
So as thankfully I only have 6 wk contract and gut feeling shouting at me to me to walk away, thats what I plan to do, happy to wait until its all properly terminated so can seek out better EA I will hopefully feel more comfortable with.0 -
Well have just sent letter giving two weeks notice...would anyone recommend selling privately (not sure yet if investors mentioned earlier are interested) or maybe an online agent....
My theory is if we sell privately we will be able to reduce the price as there won't be agent fees to pay.0 -

Why is it that you think that you can "magic" up a buyer when a "professional" can't?
Your property is probably sticky because there isn't much demand for your type of property in your price range in your area.

I think I'm inclined to agree with tim. As long as your ea has been listing your property on Rightmove & ea's own website if they have one, I can't see that you will have more success by selling privately.
You need to ask yourself why you think your place isn't selling. Have you had many viewers? What has the feedback been like? If you are in a good commuter area, then your property should be attracting interest if the price is right.
Investor's usually want to pay rock bottom prices for property, so you'd be better off reducing the price rather than hope an investor who will want to beat you down on the price to "make their numbers stack up" as they like to put it, will materialise. The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0
