Talkmobile Damaging my Credit File

I haven't been on here for years but i hope someone can help.
this problem is a little complicated, but effecting me massively.

On the 19/07/2011 I had a "Work" mobile set up with Talk Mobile as part of my job, never used it so never got a bill. 17/12/2011 was the last day it was used, (fault with the phone and it got put to one side) but i continued to have the phone in my possession as i was still part of my job (just not physically working). in Feb 2012 i went off work sick due to an illness until Sept 2012 when i returned still possessing the phone. In Oct 2012 i was notified of redundancy and my final date was to be sometime in Feb 2013. The phone was returned as part of my redundancy, returning company property (Car, Phone, Laptop..etc)

After i was made redundant in Feb 2013 i checked my credit file as i was looking to get a 2nd car but noticed Talk Mobile had placed 4 markers on my credit file for missed payments, now i phoned them straight away to find out why.

It turned out these missed payments were not from usage, but for not having a direct debit set up dating from June 2012 to September 2012, they say i had canceled the direct debit with my bank. But my bank have confirmed that Talk Mobile were the ones that cancelled the direct debit in January 2012. multiple phone calls later and they will not listen or change anything.

I then contacted Equifax and filed a report with them to look into it, Talk Mobile (Carphone Warehouse) have basically said it was my fault and i am liable for all charges. So equifax cannot change the records without acceptance from talkmobile.

note: the balance is for £15, £5 i have paid as a good will gesture on the fact that they will clear the markers as it is there fault (they have admitted this over the phone, but there "credit team" are unwilling to change their decision, the other £10 was paid by talkmobile to close the account.


I am currently banging my head against a brick wall and do not know what to do. a friend of mine in the financial industry has said because i have paid the debt, Talk Mobile HAVE to clear the markers. but i don't know if this is correct..


ps, the account is not defaulted. it is satisfactorily closed.

Can anyone shed some light and offer some advice please.

    Odd for a business mobile to be taken out in your own name. Did YOU sign a contract with Talk Mobile?

    No they don't, the markers are for late payment, which is now set in concrete unless the creditor agrees they made a mistake and removes them.

    No i didn't sign any contract with TalkMobile. but i would have thought there would have been some T&C's about it when i was given it. its that long ago im not sure..

    Most corporate mobile phone deals are not contracts that individuals have, but that their companies have, with the provider.

    If you didn't sign a contract with the provider then I would suggest they have no right to notify CRAs about missed payments. You were paying those bills on behalf of your company, not acting on your own behalf. That applies even if you were the nominated bill payer.

    If your file is being modified by a CRA without your permission, that's a big no-no. Unusual for any business to put their mobiles on a network used mainly by consumers.

    You need to check why you were assigned this contract without your agreement.
