In principle, I would say they can. If you are late, then interest is applied and you get a late payment charge. This then might well put you over the limit, thus incurring a further charge. Was the interest enough to put you over the limit? Or was it only the combination of interest + late payment fee that put you over?
£12 is a pretty standard penalty. But penalties should be a reflection of the losses/costs incurred by the CC.
I would phone them up and ask them nicely to refund the charges - especially if it is a first time offence. Little chance of getting the interest back.
If they refuse and you want to take it further, then I would argue (in writing) that £24 (if it was that) is disproportionate for what was, in effect, a single breach. Challenge them to justify the penalties by reference to the costs incurred by them. If but for the late payment fee you wouldn't have gone over the limit, then point out the unfairness in this.
Not saying you have a solid case, but no harm in giving it your best shot.0 -
hi thanks for your reply i thought i read somewhere they could only charge you 1 or the other. the late payement and interest made me go over but then 12 fee was put on straightaway for going over so £24 in total. my own fault for missing it just thought bit harsh lol
