But the agreement was for travel? The OP never had the intention of making the return journey so surely theyve breaking the agreement.

    No - not really.

To put it simply, and heavily paraphrase the agreement, it would have been something like "You can use the flight, or cancel it and receive a full refund." The OP chose the latter option.

It's hard to imagine an enforceable clause in the contract along the lines of "we will not refund the ticket if you were 100% sure you wouldn't use it when you bought it". Even if there was, the OP could say he was only 99.9% sure he wouldn't use it. (Had a dire emergency arisen, the tickets would have been used.)
  • The OP says Air Italia which seems to have some connection with Niki Lauda's empire. I wonder if they are actually still in business by that name, in which case the OP may be dealing with an organisation which doesn't give a ****.

Yes.... this is exactly it..... they don't give a monkey's. I've been told by various people that I've spoken too at Air Italia over the the last 6 months that either the tickets were purchased in cash (I always carry £4k around in cash), or that they were purchased by cheque - the lady who said I'd paid by cheque even called me a liar when I said they were paid for by credit card.
