    You can't make that happen.

    Agreed. Even if you take your name of the property, your lender will not allow you to be taken off the mortgage if your ex doesn't earn enough to support the mortgage on her own.

    Hi guys, my ex partner could afford to pay the mortgage. There is no equity in the property but a solicitor advised I could get a court order that will basically state she has to make the payments in full or the house is put on the market?

    Unfortunately the two missed payments will count against you.

    Thinking rationally, your current mortgage provider's thoughts will be that as a 'couple' who can't afford the whole mortgage so what chance will there be of one of you paying it all.

    They also have two people to chase if there is a default so they would be increasing their risk if one of you came off.

    Other providers would share the same view.

    You need a plan of action and only with some form of co-operation will you resolve this, especially if your ex wants the house.

    Hi, thanks for that.

    The mortgage company are aware of the situation but understandingly just want paying. A solicitor who gave me some advice said that I could essentially get some kind of order that would help as my ex partner isn't up for a sensible discussion about the property.
