Redundancy situation - TUPE etc

Afternoon all.

My company has recently announced there will redundancies and we started the 30 day consultation mid May. This is a cost reduction exercise not headcount reduction as some if not all of the jobs will be moved to cheaper labour markets such as India.

To start with they offered a voluntary redundancy package and stated they wanted 28 volunteers. They also stated that if they did not get the required volunteer take up they would move to involuntary. They encouraged people to take up the volunteer offer by also saying the voluntary severance package is much better than what would be offered in the involuntary package. The difference between the two is around 4 months salary and involuntary is still better than statutory minimum.

103 people volunteered including myself (17 years service) and offers have been made to 35 people. I was notified Wednesday that my application had not been accepted and I have a meeting with my boss this afternoon to learn why. Stated selection criteria was based upon impact on the business of letting someone go so it will be interesting to hear what he has to say.

At this point I do not know how many of the 35 offers have been accepted.

The company is still talking about involuntary redundancies and those employees who were not accepted for voluntary would still be 'in scope' along with everyone else where the ranking process comes in to play.

My question is what sort of legal advice should I be seeking at this point? I would like to know what I should know.

Do I need to engage with a specialist lawyer? Any recommendations in this regard? Any free legal services other than this great site and CAB?

    What are you trying to achieve?

    It is actualy quite difficult to make a case you should be selected for redundancy.


    you/all should have been asking the questions during the consultation period not after.

    Reasons for the redundancies
    Selection criteria
    Packages

    The reps/union should have been dealing with this as there are more than 20 going,

    Allthough by offering VR they may have got round the need for reps as technicly VR does not exist and it is a mutual agreement to terminate

  • With 17 years service it's not a surprise is it? You will cost them more to lose since by your own admission your co is employing a cost reduction.

    So, won't someone on a smaller salary and fewer years of service will be selected first?
