Redundancy and Child Care Vouchers

Help please!
I am being made redundant and been informed that my redundancy amount is to be calculated after deduction of childcare vouchers, (ie less 243 x 12= £2916) not on my gross salary.
Is this correct/legal? Thanks

It depends on whether you are getting statutory redundancy or enhanced redundancy. If the latter, it should (but not must) be calculated based on your notional salary, not post-sacrifice salary. If the former, it must based on your post-sacrifice salary according to HMRC:
