Undelivered tiles bought - Any advice appreciated

Hi all,
On the 8th June I recently bought £1600 worth or tiles with all the necessary materials to lay them from Al Murad's tiles in York, my girlfriend has now seen some others she likes for a lot less money..
These tiles are still awaiting to be delivered.
I went to ask for a refund but was shown the contract on the receipt stating 'Goods will be refunded if brought back within 28 days and would be charged a 33% re-stocking fee.'
My argument is that these tiles haven't been delivered so how could I be charged a re-stocking fee?? There reply was that they have had them delivered from the warehouse.
Do I have any rights? Any advice would be greatly appreciated.

How did you buy them? Was it in person in a shop? If so you have no rights to a refund so anything they offer is all you will get.
If you bought at a distance (e.g online) then the DSRs will apply, and they can't charge a restocking fee.0 -

The moral to this story is once you have bought stop looking, you will always fin a better deal.0

Ask them nicely to refund the difference in the form of a credit note, many stores will do this. It's not the ideal solution you're after, but since you don't really have any rights to return (unless they are faulty) you may at least be able to push for a little bit of good will.0

Just to keep you updated - I have managed to get through the head office in Leeds and said it was unreasonable to charge a 33% re-stocking fee when the tiles haven't been delivered!
They agreed and have been offered a full refund

Good result, well worth being persistent.
I agree that 33% is a bit of a ridiculous (and arbitrary) charge even if it is within the law.
Why would it cost £500 to restock £1,500 of tiles and £50 to restock £150 worth of tiles when they can both be the same weight/size?
Just seems like a money making exercise.Thinking critically since 1996....0 -

Nope, the forums are here for consumer rights, and that's what you were given, your rights. You then chose to ring them anyway, so posting was a bit of a pointless exercise.0 -
