Hi
I am hoping someone can shed a little light on my dilema.
My husband and I went bankrupt in July 2009 and discharged by July 2010.
I have recently applied (via Noddle) for my credit file. I notice I have several defaulted accounts showing. The reports started in september 2009, and have continued updateing as default, EVERY month since, the last being May of this year 2013.
I have written to all of these accounts, enclosing coppies of the bankruptcy order and discharge notice, using the letter template I was gratefull to find on here.
I have heard nothing from these companys, but they still put the default up a month after these letters were sent.
I have 2 questions.
1 - I have heard that these defaults will be removed after 6 years, my question - Is this 6 years after the first default date - 2009, or would it be the last default date - 2013 ?
2 - How do I get these companies to acknowledge my correspondence? They all had copies of the bankruptcy notice sent to them in 2009, followed with a further copy and a copy of the discharge notice in 2010, then copys of both again March this year 2013. I am unsure of the account numbers for these accounts, as Noddle only shows the last 4 digits. So I am wondering if this is the reason the creditors are ignoring my letters ?
Very long, but thanks for any advice you can give.

1. They are not new defaults each month, but just status updates on the original. The default and account will still fall off 6 years from the initial default date.
2. Who are the companies? Account numbers should not matter, as long as they have enough detail to find the accounts by other means. However, did you not put the account numbers on your BR paperwork?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I see I wasnt sure exactly how it worked, so I am probably better off waiting until the 6 years are over, as it will be around the same time the Bankruptcy comes off the file.
I do have the account numbers, but when I tried to phone the companys in 2009 and 2010 they told me that the account number wasnt valid as it had gone to a default account number, but were unable to give me that information. I can see from the credit file that the last 4 digits are different. It seems without these new account numbers I can do nothing. These are 2 mail order companys, Littlewoods and Look Again, but they have 10 default accounts showing, all different account numbers.0 -
Getting them sorted would mean that the default dates would be a little earlier and would also say settled while you wait for it all to fall off.
It is up to you whether you try to sort it. The default dates are not hugely after the BR, and the BR itself is a blacker mark than any unsettled account.
As said, you do not absolutely need the account numbers. Your name, address and a copy of the credit report entries is all they need to identify the accounts. If they tell you they need more, they are telling porky pies.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks for the advice, I think I might just leave them, now I know it isnt 6 years from the last entry, I can rest a lot easier.
I did read somewhere that a debt collector company can see these defaults, and attempt to chase me for the money ? I really hope this isnt the case after almost 4 years. I have moved, and the new address is now linked to the old address on the file.
I do get the feeling that I have not been given the correct information with regards to the account numbers, but I dont know if I can handle being passed from one department to another, on a premium rate number again.
In 3 years time, this horrible shadow should be lifted0 -
The unsettled defaults to not allow a debt collector to chase them on it's own. It's more that sometimes companies sell the debt on to debts collectors regardless.
Getting the accounts marked as settled can just make that less likely, as it forces the original creditor to acknowledge the debt is settled if you see what I mean.
If you want to take route with less hassle, then you could simply send or email a letter like the one in this link to the creditors.
