  • Moneyineptitude if you called up and cancelled something would you expect for them to cancel it?

of course you would - and naturally you would be very !!!!ed off if they didn't.

Its my word against them, they should keep records of phone calls esp when you can call up and cancel insurance over the phone!
    .
Surely I have some rights – in fact, I didn’t bloody ask for the insurance in the first place!!!

Yes, but I'd also cancel the Direct Debit with the Bank and check to see if the payments actually stopped.
As for your "rights" , I think you'll find you don't have any unless you can prove that the cancellation request was actually made.
  • in hundsight i should have checked but i didnt.

If i dont have a leg to stand on why has Martin Lewis put this on the website then:

Trawling through my bank statement, I had been paying for mobile phone insurance I wasn't using since 2009!! Cancelled the direct debit and was informed the refund for £856 would be with me within 7 days! Kerching!

You asked if you had "rights"; you obviously don't in your particular circumstance.

Any refund is entirely at the discretion of the insurance provider. You'll have to rely on proof of your 'phone upgrades just as the operator told you, but the company are not obliged to refund you anything.
  • just an update:

the insurance company have written offering 360.00 for 4 years of payment (it should be 6 years) and they will give me the whole about back if i can prove when i upgraded my phone.

was very impressed with that and t-mobile are now sending me the letter with my upgrade information from 2007 :money:

    Well done.:T
The moral of this story, as I said earlier, is to take a few minutes each month to check your statements. It's also wise to cancel direct debits with both your bank and the recipient at the same time to save any repeat of your experience.
  • yes i will do!

can pay some money off my credit card now
